By using your Subcard® (either as a traditional card or as a virtual card) you agree to these terms and conditions (Terms). If you have any questions about your Subcard®, call 0800 78 22 73 or write to PO Box 8193, Symonds Street, Auckland 1150. References to “Subcard®” in these terms and conditions are references to the traditional physical card, the virtual card (used as part of the Subcard® loyalty program) and the validly registered Subway® eGift Card. The Subcard® loyalty programme in New Zealand is operated by Subway NZ Limited (herein after referred to as “SNZ”, “we”, “our”, “us”).
The credits stored on your Subcard® for purchasing products at participating Subway® restaurants may comprise from time to time of (i) any credit that you have loaded onto your Subcard® and/or, (ii) any credit that someone else has loaded onto your Subcard® as a gift and/or, (iii) any credit contained on a validly registered physical Gift Card or virtual eGift Card which has been linked with your Subcard® (together your, " Subcard® Balance").
Subcard® Reward Dollars will automatically expire 12 (twelve) months after the date that you earn them. The credits loaded onto your Subcard® that comprise your Subcard® Balance will automatically expire 12 (twelve) months after the date that each credit was loaded onto your Subcard®.
When your credits comprising your Subcard® Balance or Subcard® Reward Dollars expire, you can no longer use them, and have no right to any refund. If you wish to redeem your Subcard® Reward Dollars for approved Subway® products or spend your Subcard® Balance, you must do so before they expire. Subcard® Reward Dollars and Subcard® credit are not transferable to another individual.
Additional credit will not be able to be loaded onto any Subcard® issued prior to 18 September 2017. Only Subcard®’s issued after 18 September 2017 will be valid after this date.
The Subway® App and the virtual Subcard®
To use the virtual card you must download the Subway® App from your App store on either a iOS or Android device. The barcode display of your virtual card on your mobile phone must be appropriate for scanning using our in-restaurant software. You are responsible for costs involved in implementing and using the Subway® App, on your mobile device.
You must check regularly for updates to the Subway® App, and you must download all updates promptly.
If you have problems downloading the Subway® App, your phone model may not be supported. The Subway® App can be used on phones which support Android and iOS.

An eGift Card can also operate as a Subcard®, once the eGift Card is validly registered.
To register an eGift Card, you will need to follow the steps below under the heading "REGISTER YOUR Subcard® within the Subcard® website (the Website).

Ownership of your Subcard®
Your Subcard®, the Subway® App and card number are the property of Subcard® NZ Limited. You must not copy or reproduce your Subcard® or the software for the Subway® App, the physical card or the virtual card, and you must not interfere with the operation of the Subway® App, the physical card or the virtual card.
Registering your Subcard®
If you have a traditional Subcard® card - you need to register it before you can use it to redeem Subcard® Reward Dollars or load credit online. Credit loaded onto your Subcard® in-restaurant can be redeemed irrespective of registration. You don’t need to register in order to collect Subcard® Reward Dollars, only to redeem the Reward Dollars.
If you have a virtual card, but you don’t have a traditional card - your virtual card is automatically registered using the details you provide when you apply for that virtual card.
There are three ways to register your traditional Subcard® card:
- Download the Subway® App and follow the prompts to enter the information requested; or
- login here, follow the links and use the 4 digit Access Code provided with your Subcard®; or
- call 0800 78 22 73 and register with a Subcard® representative.
If you have a validly registered physical Gift Card or eGift Card - you can also register a physical Gift Card or eGift Card to operate as a Subcard®, by using the same steps for registering your traditional Subcard®, as described above. Once a physical Gift Card or eGift Card has been registered the user can redeem Subcard® Reward Dollars or load additional credit in-restaurant or online. Credit loaded onto your physical Gift Card or eGift Card can be redeemed irrespective of registration. You do not need to register your Gift Card or eGift Card to collect Subcard® Reward Dollars, only to redeem the Reward Dollars.
You must have a minimum balance of NZ$3 (three) Subcard® Reward Dollars and your Subcard® must be registered before you are eligible to redeem your Subcard® Reward Dollars for approved Subway® products.
Linking your traditional Subcard® card with your virtual card
If you have a traditional Subcard® card, you need to follow the prompts on the Subway® App to link your traditional Subcard® card with a virtual card. They will then link to the same records, which are updated in real time. You can use either Subcard® in restaurant, and both cards will be updated regardless of which one was scanned in the restaurant.
If your traditional Subcard® isn’t registered yet, and you try to link with a virtual card, you’ll be prompted to register your account.
Linking your eGift card with your traditional or virtual Subcard® card
You may link your physical Gift Card or eGift Card credit with the Subcard® loyalty program. You can do this in one of two ways:
- Link with a virtual Subcard®; or
- Link with a traditional Subcard® card.
Additional terms and conditions apply to the Subcard® loyalty program.
Upon linking your physical Gift Card or eGift Card with the Subcard® loyalty program including both the virtual and physical Subcard®, you also agree to these Subcard® terms and conditions.
To link your physical Gift Card or eGift Card with a virtual Subcard®, you must first download the Subway® App. You can download the Subway® App from your App store on either an Apple or Android device.
Additional terms and conditions apply to the Subway® App, and can be found within the Subway® App on the "About Subway® App" section.
You must then follow the prompts on the Subway® App to link your physical Gift Card or eGift Card 16 Digit Number and Access code.
Your physical Gift Card or eGift Card will then link to the same records, which are updated in real time. You can use either the physical Gift Card or eGift Card in restaurant, or the virtual card using the Subway® App, and both will be updated regardless of which one was scanned in restaurant.
If your physical Gift Card or eGift Card isn’t registered yet, and you try to link with a virtual card, you’ll be prompted to register.
To link your eGift Card with a physical Subcard®, you must already have a registered Subcard® account. Simply log in by visiting www.subcard.co.nz and then select "Combine Cards", this process will take approximately 48 hours to update.
Nature of your Subcard®
Your Subcard® can be used as:
- a Gift Card or Purchase Card to purchase products at Subway® restaurants; and/or
- a Rewards Card to collect Subcard® Reward Dollars towards approved Subway® products.
Subcard® is not a credit or charge card and cannot be exchanged for cash or for any orders placed via a third party aggregator.
Using your Subcard® as a gift card/purchase card
You can load your traditional or virtual Subcard® with credit between NZ$10 (ten) and NZ$1,000 (one thousand) at any Subway® restaurant or online. You can only load your validly registered physical Gift Card or eGift Card with credit up to a maximum Subcard® Balance of NZ$1,000. You can reload your Subcard® with additional credit (up to the permitted maximum balance) at any time, except as notified in writing for special circumstances. Your Subcard® Balance loaded onto your Subcard® can be used to purchase products at Subway® restaurants only.
You can also load your Subcard® with credit online at any time. You will be required to enter in your 16 Digit Subcard® Number. Payment can be made using a credit card (Visa or Mastercard only). Please enter your 16 Digit Subcard® number carefully, Subcard® NZ Limited will not be liable if you enter the wrong 16 Digit Subcard® number and load credit onto the wrong Subcard®. If this happens please contact us immediately on 0800 78 22 73 and we will attempt to resolve the matter.
You acknowledge and agree that you will not earn, nor do you have any right to earn, interest on the Subcard® Balance stored on your Subcard® from time to time.
Earning Subcard® reward dollars
You can earn Subcard® Reward Dollars every time you make a purchase at a Subway® restaurant and scan your traditional or virtual Subcard® at the cash register.
The rewards value for calculating Subcard® Reward Dollars may change from time to time without prior notice to you.
You cannot earn Subcard® Reward Dollars for the following:
- when credit is loaded onto your Subcard®;
- the initial purchase of a Subway® Gift Card or an eGift Card;
- when making a purchase using Subcard® Reward Dollars;
- purchases made using third party delivery platforms;
- purchases made using third party food aggregators;
- delivery on any purchase; or
- free products.
If you return a product or receive a refund on a product, we reserve the right to reverse the Subcard® Reward Dollars earned for the original purchase. No Subcard® Reward Dollars will be earned on previous or historical purchases.
Redeeming Subcard® reward dollars
You can redeem your Subcard® Reward Dollars for approved Subway® products. You must have a minimum balance of NZ$3 (three) Subcard® Reward Dollars on your Subcard® and your Subcard® must be registered before you are eligible to redeem your Subcard® Reward Dollars for approved Subway® products.
Subcard® Reward Dollars cannot be redeemed for cash.
Approved Subway® products are subject to availability and may be withdrawn or substituted at any time.
We will deduct the appropriate number of Subcard® Reward Dollars from your Subcard® Balance when you redeem Subcard® Reward Dollars for approved Subway® products.
Subcard® Reward Dollars cannot be used to make purchases through third-party aggregators or delivery companies and cannot be transferred to any other reward program.
Information about your Subcard®
Details of your Subcard® Balance and Subcard® Reward Dollars, if any, will appear on your receipt each time you make a purchase using your Subcard® at Subway® restaurants.
You can also check details of:
- your Subcard® Balance;
- your Subcard® Reward Dollars; and
- your Subcard® Reward Dollars and Subcard® Balance expiry dates; by logging on here and following the links, or by checking on the Subway® App.
Lost or stolen cards or mobile phones
If your Subcard® is lost, stolen or destroyed (including but not limited to the loss of your mobile phone containing your Subcard® in the form of the virtual card), you must promptly freeze the Subcard® Balance and Subcard® Reward Dollars on your card by logging in here and clicking on the "LOST OR STOLEN" tab or calling 0800 78 22 73.
Provided your Subcard® was registered, we can freeze the remaining Subcard® Reward Dollars and Subcard® Balance on your old Subcard® from the time that you report to us (by logging on here and clicking on the "LOST OR STOLEN" tab or calling 0800 78 22 73) that your Subcard® is lost, stolen or destroyed.
You must then visit a Subway® restaurant to collect a brand new card without any transactions on it. Do not scan this card in restaurant. Instead, when you have your new card number, return to this website and log back into your current account and you can transfer your old Subcard® Reward Dollars and Subcard® Balance and personal details to the new card by following the prompts.
By clicking SUBMIT in the “LOST OR STOLEN” section of this website you agree to freeze your Subcard®. This action is not reversible and you will not be able to collect Subcard® Reward Dollars or redeem Subcard® Reward Dollars or view your Subcard® Balance until you have returned to this website with your new card (without any transactions on it) and number.
We may require proof of your identity (including photo identified caption) to freeze Subcard® Reward Dollars and Subcard® Balances, replace a card, or credit a replacement Subcard® with previously earned Subcard® Reward Dollars or a previously loaded Subcard® Balance. The crediting of a replacement Subcard® is at SNZ’s sole discretion.
Transferring Subcard® Reward dollars and Subcard® Balance
To transfer Subcard® Reward Dollars and Subcard® Balance to a new Subcard® you will need to visit a Subway® restaurant and collect a brand new traditional card without any transactions on it. Do not scan this traditional card in restaurant. Instead return to this website when you have your new card number and you can transfer your original Subcard® Reward Dollars and Subcard® Balance and registration details to the new card.
You cannot sell or convert your Subcard® Reward Dollars or Subcard® Balance into cash.
New Zealand only
Your Subcard® can only be used at participating Subway® restaurants in New Zealand.
Variation of these terms
We reserve the right to vary, suspend, modify or terminate these Terms at any time without prior notice for reasons beyond our reasonable control. Any changes to these Terms will be posted on this Website, and issued in an update for the Subway® App, and you will be bound by those amended terms and conditions. We recommend that you review the terms and conditions from time to time. If you do not agree with any of the terms and conditions as amended from time to time, you must cease using your Subcard®.
Suspension / Cancellation of your Subcard®
We reserve the right to suspend or cancel your Subcard® at any time without prior notice if we consider you have used your Subcard® fraudulently, if there is no activity on your Subcard® for a reasonable period of time, if there is no Subcard® Balance, or if you are otherwise in contravention of these Terms or the law in general. Where we cancel your Subcard®, any unused Subcard® Reward Dollars or Subcard® Balance will be valid for three months from the date of cancellation, after which any unused Subcard® Reward Dollars or Subcard® Balance expire. The three month validity period does not apply to a Subcard® which is lost, stolen or destroyed. You can cancel your Subcard® by writing to PO Box 8193, Symonds Street, Auckland, 1150. Where you cancel your Subcard®, any unused Subcard® Reward Dollars or Subcard® Balance will expire immediately.
Children under 18 years of age are required to obtain the express permission of a parent or guardian before submitting any Personal Information about themselves.
Collection and Use of Customer Information
Holders of a Subcard® may voluntarily register their cards through the Subcard® website, by calling 0800 78 22 73, or by using the Subway® App.
It is your responsibility to keep us up to date of your personal information provided to us including your email address.
You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 1993. You may access and request correction of your personal information held by our selected third parties by contacting the Privacy Officer by telephone at +64 9 367 4400; by email at email@example.com; or by mail at PO Box 8193, Symonds Street, Auckland 1150.
Limitation of liability
To the extent permitted by law, we do not accept responsibility for, and we will not be liable for, any loss or damage suffered by you, however caused, in connection with or arising from your Subcard® or use of this website or the Subway® App or the virtual card in respect of:
- any unavoidable delay in replacing your Subcard®;
- any unauthorised use of your Subcard® or the Subway® App;
- any approved Subway® product not being available for any reason beyond our reasonable control;
- any failure to credit you with Subcard® Rewards Dollars due to technical issues beyond our reasonable control;
- any problems or technical malfunction of the Subway® App, the virtual card, or any network or lines, servers or providers;
- any failure to notify you of any changes in these Terms; or
- any failure to notify you of cancellation of your Subcard®.
SNZ reserves the right to grant or refuse participation in the Subcard® loyalty program at its discretion. You acknowledge and agree that all decisions pertaining to Subcard® matters rest solely with us and our decision is final.
All conditions and warranties, whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under or in relation to your Subcard® are expressly excluded to the full extent permitted by law. Any liability we may have to you under legislation in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again.
You may have rights under the Consumer Guarantees Act 1993 which are not excluded or limited by anything set out in these Terms. Each exclusion or limitation of liability in these Terms also applies to the owners and operators of Subway® restaurants, Subway Franchisee Advertising Fund Trust B.V., Doctor’s Associates Inc., Subway® Development Agents and their related companies (as defined in the Companies Act 1993), employees and agents.
If any of these terms and conditions are determined to be illegal, invalid or otherwise unenforceable, then the remaining terms and conditions shall continue in force and effect.
These Terms and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with New Zealand law. Disputes arising out of or in connection with use of the Subcard® or these Terms shall be subject to the non-exclusive jurisdiction of the New Zealand courts.
